OVERVIEW

This website and online store are operated by L'Una Music Group LLC under the trade name MOHOMBI. Throughout the website, the terms “MOHOMBI,” “we,” “us,” and “our” refer to L'Una Music Group LLC, the legal operator and seller of the MOHOMBI store.

Our store is hosted by Shopify, which provides the ecommerce platform that allows us to offer and sell products to you. Our made-to-order products are manufactured and fulfilled through Printful.

These Terms of Service (“Terms”) govern your access to and use of our website, online store, products, content, features, and related services (collectively, the “Services”).

By accessing our website, creating an account, or placing an order, you agree to these Terms and to the policies incorporated into them, including our:

Privacy Policy;
Shipping Policy;
Return and Refund Policy; and
Cookie Policy.

If you do not agree to these Terms, you should not use the Services or place an order.

L'Una Music Group LLC is the seller and merchant responsible for purchases made through this store. Shopify provides the ecommerce platform, and Printful provides production and fulfillment services. Neither Shopify nor Printful is the seller of the products offered through this store.

ELIGIBILITY

You must be at least the age of legal majority in your country or place of residence to place an order.

If you are under the age of legal majority, you may use the Services only with the involvement and authorization of a parent or legal guardian.

By placing an order, you confirm that:

You have the legal capacity to enter into a binding agreement;
The information you provide is accurate and complete;
You are authorized to use the selected payment method; and
Your purchase is for lawful purposes.

PERSONAL AND NON-COMMERCIAL USE

Products sold through our store are intended primarily for personal use.

You may not purchase products for unauthorized resale, commercial reproduction, counterfeiting, promotional distribution, or any activity that infringes our intellectual-property rights.

PRODUCTS AND MADE-TO-ORDER FULFILLMENT

Most products are created only after an order is placed. Products may be manufactured, printed, packaged, and shipped by Printful or another authorized fulfillment partner.

We make reasonable efforts to display product descriptions, sizes, materials, colors, designs, and images accurately. However:

Screen settings may affect how colors appear;
Product colors may vary slightly between production batches;
Printed designs may have minor variations in placement or appearance;
Measurements may vary within reasonable manufacturing tolerances; and
Product packaging may vary depending on the fulfillment location.

These minor variations are not necessarily defects.

Please review the product description and applicable size guide before placing an order.

PRODUCT AVAILABILITY

Products, colors, sizes, designs, and other options may be changed, limited, suspended, or discontinued without prior notice.

We may limit the quantities available to any person, household, geographic region, or jurisdiction.

Adding a product to your cart does not reserve it or guarantee its availability. Availability is confirmed only when we accept your order.

ORDER PROCESS

When you submit an order, you are making an offer to purchase the selected products under these Terms.

An automated order confirmation acknowledges that we received your order. It does not necessarily mean that the order has been accepted.

We may accept the order when payment is authorized and the order is submitted for fulfillment. We reserve the right to reject or cancel an order before fulfillment for legitimate reasons, including:

Product unavailability;
Pricing or description errors;
Payment failure;
Suspected fraud or unauthorized activity;
Shipping restrictions;
Sanctions or legal restrictions;
Unusually large or repeated orders;
Incorrect or incomplete customer information; or
Violation of these Terms.

If we cancel an order after payment has been collected, we will refund the cancelled amount to the original payment method.

ORDER INFORMATION

You agree to provide current, complete, and accurate purchasing, billing, payment, contact, and shipping information.

You are responsible for reviewing the following information before placing an order:

Product;
Design;
Size;
Color;
Quantity;
Shipping address;
Billing address;
Email address; and
Telephone number.

Contact us immediately if you discover an error. Because production may begin shortly after an order is placed, we cannot guarantee that an order can be changed or cancelled after submission.

PRICES AND CURRENCY

Product prices are displayed in the currency selected or shown on the website.

Prices may change without notice. A price change will not normally affect an order that we have already accepted, except where a clear pricing error has occurred.

Depending on your location, your bank or payment provider may apply:

Currency-conversion charges;
International transaction fees;
Payment-processing charges; or
Other bank fees.

These charges are determined by your payment provider and are not controlled by us.

TAXES, CUSTOMS, AND IMPORT CHARGES

Applicable sales tax, VAT, or other taxes may be calculated and displayed during checkout.

International orders may be subject to customs duties, import taxes, brokerage fees, processing charges, or other government fees.

Unless expressly included and collected during checkout, these charges are the customer’s responsibility.

PAYMENT

Available payment methods are displayed at checkout and may be provided by PayPal, card networks, or other third-party payment providers enabled for the store.

The availability of a payment method may depend on your location, currency, device, and the provider’s eligibility requirements.

By submitting payment information, you represent that:

You are authorized to use the payment method;
The information provided is accurate;
The payment provider may charge the total order amount; and
We and our providers may conduct authorization, verification, security, and fraud-prevention checks.

We do not generally receive or store complete payment-card numbers.

If a payment is declined, reversed, charged back, or identified as unauthorized, we may suspend fulfillment, cancel the order, or take reasonable steps to recover amounts properly owed.

SHIPPING AND DELIVERY

Order processing, production, shipping, tracking, customs, delayed packages, and lost-package claims are governed by our Shipping Policy.

Delivery dates are estimates unless expressly stated otherwise. Delays may occur because of production demands, customs processing, carrier disruption, severe weather, government action, or other events outside our reasonable control.

Nothing in these Terms removes any mandatory delivery rights provided by applicable consumer law.

RETURNS, REFUNDS, AND CANCELLATIONS

Returns, replacements, refunds, and cancellations are governed by our Return and Refund Policy.

Because most products are made to order, we generally do not accept voluntary returns or exchanges for buyer’s remorse, change of mind, or an incorrectly selected size or color, except where applicable law grants a mandatory right of withdrawal.

Damaged, defective, misprinted, or incorrect products must generally be reported within 30 days after delivery.

Packages believed to be lost in transit must generally be reported within 30 days after the estimated delivery date.

Nothing in these Terms limits your rights regarding products that are faulty, damaged, unsafe, or not as described.

EUROPEAN AND UNITED KINGDOM CONSUMERS

If you are a consumer in the European Economic Area or United Kingdom, you may have a legal right to cancel an eligible online purchase by notifying us within 14 days after receiving it.

Certain products made according to your individual specifications or clearly personalized for you may be excluded from the statutory cancellation right.

These exclusions do not affect your rights when a product is defective, damaged, or not as described.

BRAZILIAN CONSUMERS

Consumers located in Brazil may exercise the applicable statutory right of withdrawal for eligible online purchases within seven calendar days after receiving the product.

Nothing in these Terms limits any mandatory rights available under Brazilian consumer law.

ACCOUNTS

You may be able to create a customer account.

You are responsible for:

Providing accurate account information;
Maintaining the confidentiality of your login credentials;
Using a strong and unique password;
Restricting access to your device; and
Notifying us promptly of suspected unauthorized access.

You may not impersonate another person, create an account using false information, or use another person’s account without permission.

We may suspend or close an account that is used fraudulently, unlawfully, or in violation of these Terms.

INTELLECTUAL PROPERTY

The website and its content, including the MOHOMBI name, stage name, trademarks, logos, music-related branding, photographs, portraits, likenesses, artwork, product designs, graphics, videos, text, layout, software, and other materials, are owned by or licensed to MOHOMBI and/or L'Una Music Group LLC and are protected by applicable intellectual-property laws.

Accessing the website or purchasing a product does not transfer ownership of any intellectual-property right to you.

You may not, without prior written authorization:

Copy, reproduce, republish, distribute, or sell website content;
Use MOHOMBI’s name, image, likeness, logos, artwork, or trademarks commercially;
Manufacture or sell unauthorized merchandise;
Create counterfeit or derivative products;
Remove copyright, trademark, or ownership notices;
Scrape or systematically extract website content;
Use content to train artificial-intelligence or machine-learning systems;
Frame or mirror the website; or
Suggest an endorsement, partnership, or affiliation that does not exist.

You may use the website only for personal, lawful, and non-commercial shopping purposes.

CUSTOMER CONTENT AND REVIEWS

If you submit a review, photograph, comment, message, suggestion, or other content to us, you confirm that:

You own or control the necessary rights;
The content is accurate and lawful;
The content does not infringe another person’s rights;
The content is not defamatory, abusive, discriminatory, fraudulent, or misleading; and
The content does not contain malware, unauthorized advertising, or private information belonging to another person.

You grant us a worldwide, non-exclusive, royalty-free license to host, reproduce, display, publish, adapt, and use content that you intentionally submit for public display, marketing, customer support, or operation of the Services.

This license does not transfer ownership of your content to us.

We may remove customer content that violates these Terms or applicable law.

To violate intellectual-property, privacy, publicity, or consumer rights;
To submit false payment or identity information;
To interfere with the website’s operation or security;
To transmit viruses, malware, or harmful code;

To access another person’s account;

To make fraudulent claims, returns, chargebacks, or refund requests;

We are not responsible for a third party’s independent acts, content, policies, or services, except to the extent that applicable law makes us responsible.

The website may contain links to third-party websites or services.

We do not control and are not responsible for the content, availability, security, or privacy practices of third-party websites. A link does not necessarily indicate that we endorse or sponsor the third party.

You should review the applicable terms and privacy policies before using a third-party service.

PRIVACY

Our collection and use of personal information are described in our Privacy Policy.

By using the Services, you acknowledge that personal information may be processed by Shopify, Printful, payment providers, shipping providers, and other service providers as necessary to operate the store and fulfill orders.

ERRORS AND INACCURACIES

Occasionally, the website may contain typographical errors, inaccurate information, or omissions relating to:

Product descriptions;
Pricing;
Promotions;
Availability;
Shipping charges;

We may correct errors, update information, or cancel an affected order.

If an accepted order is affected by a material error, we will notify you and provide an appropriate option, which may include confirming the corrected order or receiving a refund.

PROMOTIONS AND DISCOUNT CODES

Promotions and discount codes may be subject to additional conditions.

Unless otherwise stated:

Discounts cannot be combined;
Codes have no cash value;
Codes cannot be applied after an order is completed;
Codes may be limited by product, customer, region, or time period; and
We may cancel a promotion affected by fraud, abuse, or a technical error.

STATUTORY WARRANTIES AND CONSUMER RIGHTS

Products remain covered by all warranties and guarantees that cannot legally be excluded.

We do not guarantee that:

Every product will remain available;
Every website error will be corrected immediately; or
The Services will be free from every harmful component or third-party disruption.

This disclaimer does not apply to mandatory product-quality standards, statutory warranties, or other rights that cannot legally be excluded.

LIMITATION OF LIABILITY

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for:

Fraud or fraudulent misrepresentation;

Intentional misconduct or gross negligence where it cannot be excluded;
Breach of mandatory consumer rights; or

We are not responsible for losses caused solely by:

Incorrect information provided by the customer;
Unauthorized use of a customer account or payment method;
A customer’s failure to follow product-care instructions;
Events outside our reasonable control; or
Independent third-party services for which applicable law does not make us responsible.

For customers purchasing in the course of a business, and to the extent permitted by law, our total liability relating to an order will not exceed the amount paid for the product giving rise to the claim.

This limitation does not reduce the rights of customers purchasing as consumers.

INDEMNIFICATION

If you use the Services for business or commercial purposes, you agree, to the extent permitted by law, to indemnify L'Una Music Group LLC and MOHOMBI against third-party claims, damages, liabilities, and reasonable costs arising from:

Your unlawful use of the Services;
Your infringement of another person’s rights;
Content you submit;
Your unauthorized resale or reproduction of products; or
Your material violation of these Terms.

This section does not apply to consumers where prohibited by applicable law.

TERMINATION

We may suspend or terminate access to the Services when reasonably necessary because of:

A material violation of these Terms;
Fraud or suspected unauthorized activity;
Security risks;
Abuse of our staff, customers, or systems;
Legal or regulatory requirements; or
Discontinuation of the Services.

Termination does not affect rights or obligations that arose before termination, including payment obligations and provisions intended to survive termination.

FORCE MAJEURE

We are not responsible for a delay or failure caused by circumstances outside our reasonable control, including natural disasters, severe weather, fire, flood, epidemic, war, civil unrest, labor disputes, transportation disruption, carrier interruption, government action, power failure, or telecommunications failure.

We will take reasonable steps to reduce the impact of such events.

This section does not remove any right to a refund or other remedy that applicable consumer law grants because of a significant delay or failure to deliver.

COMPLAINTS AND DISPUTE RESOLUTION

If you have a complaint, contact us first at boutique@lunaxstudios.com. Please include your name, order number, and a clear explanation of the issue.

We will attempt to resolve complaints fairly and within a reasonable period.

Nothing in these Terms prevents a consumer from using a competent consumer-protection authority, data-protection authority, mediation procedure, or court available under applicable law.

GOVERNING LAW

These Terms are governed by the laws of the State of Georgia and applicable United States federal law, without regard to conflict-of-law principles.

However, if you are a consumer living in another country, this choice of law does not deprive you of mandatory protections provided by the laws of your habitual residence.

Subject to applicable mandatory consumer protections and jurisdictional requirements, disputes relating to these Terms or the Services will be submitted to the competent state or federal courts located in Fulton County, Georgia.

SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted or removed to the minimum extent necessary.

The remaining provisions will continue in effect.

NO WAIVER

A delay or failure to enforce a provision of these Terms does not waive the right to enforce it later.

ASSIGNMENT

You may not transfer your rights or obligations under these Terms without our written consent.

We may transfer our rights or obligations as part of a legitimate sale, restructuring, financing, or transfer of our business, provided that doing so does not reduce mandatory consumer protections.

ENTIRE AGREEMENT

These Terms and the policies referenced in them form the entire agreement between you and us concerning your use of the Services and your purchases.

They replace prior communications or understandings concerning the same subject matter.

CHANGES TO THESE TERMS

We may update these Terms to reflect changes to our Services, business practices, technology, or legal obligations.

The revised version will be posted on this page with an updated “Last updated” date.

Changes will apply prospectively unless applicable law allows or requires otherwise. The Terms in effect when an order was accepted will generally continue to govern that order.
